TERMS AND CONDITIONS

1.0 Medical and Wellness Scope

1.1 Non-Medical Status: Vitality Centre provides complementary wellness and lifestyle services. We are not a medical practice and do not provide medical diagnosis, clinical treatment, psychiatric care, or prescribed medical advice.

1.2 Advisory Nature: All information shared verbally or in writing is intended for general wellness and educational purposes. It is not a substitute for professional medical advice from a registered healthcare practitioner.

1.3 Pre-existing Conditions: Clients are advised to consult their GP or qualified specialist regarding any medical concerns, suspected allergies, or diagnosed conditions before beginning a new wellness programme.

1.4 Right of Refusal: We reserve the right to decline or postpone a service if we reasonably believe it may be unsuitable or contra-indicated for your wellbeing.


2.0 Results and Expectations

2.1 Individual Variability: Wellness outcomes vary significantly based on personal factors such as lifestyle, medical history, and adherence to recommendations. Consequently, we do not guarantee specific medical or physical cures.

2.2 Illustrative Materials: Testimonials and “before and after” photographs reflect individual experiences and are illustrative of potential outcomes rather than a promise of identical results.

2.3 Commitment to Quality: In accordance with the Consumer Rights Act 2022, all services will be provided with reasonable care and skill by trained staff.


3.0 Wellness and Food Sensitivity Testing

3.1 Non-Diagnostic Testing: Wellness tests (e.g., Food Sensitivity, Bio-scans) are non-medical and non-clinical. They are used to provide wellness insights and do not diagnose medical conditions like coeliac disease, IBS, or hormonal imbalances.

3.2 Medical Consultation: Test results should be reviewed with a registered GP or dietitian before making significant changes to medication or medical treatment.

3.3 Emergency Symptoms: If you experience severe symptoms—such as respiratory distress, unexplained weight loss, or acute pain—you must seek immediate medical attention from a physician or emergency services.

3.4 Disclaimer: To the fullest extent permitted by law, Vitality Centre accepts no responsibility for decisions voluntarily made by a client following receipt of non-diagnostic wellness information. Without responsibility, any results or information issued are provided without the reflection or inquiry which a careful inquiry would require, i.e., a medical diagnosis or opinion and should not be relied upon to make health decisions or acted upon otherwise.


4.0 Consent and Liability

4.1 Informed Consent: By attending a treatment, you acknowledge that you have been informed of common risks, such as temporary skin irritation, marks, breakout, gastrointestinal upset, vomiting, bloating, cramping or digestive discomfort, and provide your consent to proceed.

4.2 Accuracy of Information: The safety of our services depends on the accuracy of the health information you provide. You agree to disclose all relevant medical history, current medications, and pregnancies during your intake.

4.3 Statutory Liability: Nothing in these terms seeks to exclude or limit liability for death or personal injury caused by our negligence, nor any other liability that cannot be excluded under Irish law.

4.4 Liability Cap: To the maximum extent permitted by law, our total liability to you for any claim arising out of our services or otherwise shall be limited to the total amount paid by you for the specific treatment giving rise to the claim.

4.5 Minors and Consent: Clients under the age of 18 must be accompanied by a parent or legal guardian, who must provide written consent and remain on the premises during the duration of the treatment.

4.6 The client agrees to indemnify and hold harmless Vitality Centre LTD against any losses, costs, or claims arising from the client’s failure to provide accurate health information or their failure to follow aftercare instructions provided by the practitioner.


5.0 Cancellations and Statutory Rights

5.1 Cancellation Policy: We require 48 hours’ notice for cancellations or rescheduling. For cancellations made within this window, a booking fee shall be retained to cover the cost of the reserved time.

5.2 If a client arrives late, the session will still end at the scheduled time to avoid delaying subsequent clients. The full service fee remains applicable.

5.3 If a client is more than 15 minutes late, the appointment may be treated as a ‘No-Show’ and the fee forfeited.

5.4 Consumer Rights: If a service does not meet the standards required by the Consumer Rights Act 2022, you are entitled to statutory remedies. Dissatisfaction with a service will be reviewed on a case-by-case basis. Any claim or liability is capped to the maximum at the price paid by you for the service. 

5.5 Refunds: Refunds for prepaid packages or unsuitable treatments will be processed in accordance with your statutory rights.


6.0 Feedback and Reputation

6.1 Open Communication: We value genuine feedback. If you have a concern, please contact us in writing so we can work to resolve the matter fairly.

6.2 Prior Discussion Policy: Clients agree that before posting negative public reviews, they will first engage in our formal process to allow for an amicable resolution.

6.3 Protection of Reputation: While we respect the right to honest opinion under the Defamation Act 2009, we reserve the right to protect our business reputation against statements that are demonstrably false or malicious.

6.4  Confidentiality of Correspondence: All private communications between Vitality Centre LTD and the client—including but not limited to emails, direct messages, and consultation notes—are intended solely for the recipient. The client or recipient agrees that these communications are confidential and shall not be published, shared, or displayed in any public forum (including social media or review sites) without the express written consent of Vitality Centre LTD. Unauthorised disclosure of private correspondence may be treated as a breach of contract and/or an infringement of the practitioner’s privacy rights


7.0 Policies and Service Conditions

7.1 Policy and Price Updates: Vitality Centre LTD reserves the right to amend its policies, service descriptions, and pricing at any time. While we strive for accuracy, all advertisements, social media posts, and website content are deemed an invitation to treat and do not constitute a binding contract until your booking is formally accepted and confirmed by the clinic. Outdated promotional offers or archived web content will not be honoured. In the event of a genuine pricing or description error, we reserve the right to cancel the booking and provide a full refund of any deposit paid.

7.2 Service Cancellation by the Clinic: We reserve the right to cancel or postpone a treatment at our discretion (e.g., due to staff illness, equipment failure, or if a practitioner deems the treatment clinically unsuitable). In the event of a cancellation by us, your sole remedy is a full refund of the prepaid amount or a credit toward a future appointment. We shall not be liable for any indirect or consequential losses, such as travel costs.

7.3 Refusal of Service: Vitality Centre LTD maintains a zero-tolerance policy regarding abusive behaviour, intoxication, or the provision of false medical information. We reserve the right to refuse service or terminate a session immediately under such circumstances. In cases of client misconduct or breach of these terms, a refund may be withheld to cover the costs of the reserved time and resources in relatin to any conduct which, in the sole discretion of the practitioner, is deemed inappropriate or unsafe.

7.4 Client Responsibility: These terms are issued in accordance with the Consumer Rights Act 2022. By booking a treatment, the client acknowledges they have had the opportunity to review these terms. It is the client’s responsibility to ensure they understand the policies regarding cancellations, health disclosures, and service expectations prior to payment.

7.5 Severability: If any part of these terms is found by an Irish court to be invalid or unenforceable, that specific part shall be severed, and the remainder of the terms shall continue to be valid and enforceable to the fullest extent permitted by law.


8.0 Website, Data, and Usage Terms

8.1 Right to Modify Services: Vitality Centre LTD reserves the right to amend the terms, conditions, and notices under which our website and treatments are offered. This includes, but is not limited to, changes in pricing, service availability, and administrative charges.

8.2 Data Protection & Automated Systems: We use reputable third-party providers for our booking and communication systems. While we implement strict security protocols in line with the GDPR and the Data Protection Act 2018, the client acknowledges that automated communications (such as appointment reminders) are a necessary part of the service. We maintain a comprehensive Privacy Policy and Data Processing Agreements with all providers to ensure your rights are protected.

8.2.1 By booking, the client provides “explicit consent” for the clinic to process health-related data for the purpose of the service.

8.2.2 By booking and completing an intake form, you provide explicit consent for Vitality Centre LTD to process health-related data (Special Category Data) solely for the purpose of providing your treatment safely

8.3 External Links: For your convenience, our website may contain links to external “Linked Sites.” These sites are not under our control. Vitality Centre LTD is not responsible for the content, privacy policies, or updates of any Linked Site. Inclusion of a link does not imply our endorsement of the site or its operators.

8.4 Acceptable Use: As a condition of using our website and booking system, you warrant that you will not use these platforms for any purpose that is unlawful or prohibited by these terms. You agree not to use the site in any way that could damage, disable, or impair our digital infrastructure or interfere with other users’ enjoyment of our services.

8.5 Community Guidelines & Conduct: Our website and social media platforms may include communication facilities (bulletin boards, forums, etc.). You agree to use these services only to post appropriate, relevant material. You are strictly prohibited from:

8.5.1 Posting defamatory, abusive, or harassing content (pursuant to the Defamation Act 2009).

8.5.2 Uploading files containing viruses or software protected by intellectual property laws without permission.

8.5.3 Conducting unauthorised commercial advertising or “spamming.”

8.5.4 Harvesting data or email addresses of other users without their express consent.

8.5.5 Vitality Centre LTD reserves the right to remove any content and terminate access for users who violate these standards.


9.0 Intellectual Property

9.1 All training manuals, protocols, digital content, and brand assets are the intellectual property of Vitality Centre LTD. Unauthorised reproduction, distribution, or ‘sharing’ of these materials, including for commercial use by the client or student, is strictly prohibited and may result in legal action.

9.2 All training materials, clinical protocols, digital manuals, and brand assets are the exclusive property of Vitality Centre LTD. Any unauthorised recording of sessions or reproduction of these materials for commercial or personal use is strictly prohibited and will be prosecuted


10.0 Force Majeure

10.1 Vitality Centre LTD is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, government sanctions, or pandemic-related closures/restrictions. The business does not offer refunds or returns in such cases.
