TERMS AND CONDITIONS

The following Terms and Conditions pertain to all services, products, devices, consumer policy, training, and to all treatments provided by Vitality Centre LTD. All rights reserved. 

Any website content or advertising on any platform is not meant to replace advice from your medical doctor or to promote or persuade for the purposes of advertising. As a client, stakeholder, trainee, contractor, or any person associating themselves through or with Vitality Centre, it is your legal obligation to familiarise yourself with the following. On request the following policy can be forwarded to you. By making contact, undertaking business, booking a treatment, emailing, telephoning or by having any other dealings with the company, it is understood that you have read and agree to all of the following terms and conditions. 

1.0 Terms of Use. By entering into business with Vitality Centre, using booking system, accessing its website, downloading content, images, signing Vitality Centres client intake form, booking online or by attending any class, training session, treatment, consuming any service, training or product at Vitality Centre LTD, you agree that you have read and agree to the following terms and conditions and consumer policy.

2.0 These terms and conditions apply to all services, training, all products, content, or treatment provided by Vitality Centre LTD including but not limited to any form of class, talk, workshop, diathermy, colonic hydrotherapy, liver coffee enemas, inch loss detox express, party lifestyle cleanse, biomat thermotherapy, food sensitivity testing, Bioscan Body MOT microdermabrasion, teeth whitening, nano-needling, skin products, skin needling, laser skin treatments and any other product or treatment provided by Vitality Centre LTD

3.0 You accept that Vitality Centre is a professional provider of training, and wellness treatments including teeth whitening, diathermy, colonic hydrotherapy, liver coffee enemas, probiotic implants, inch loss detox express, party lifestyle cleanse, biomat thermotherapy, food sensitivity testing, Bioscan Body MOT, Holistic Therapy Session, probiotic facial, skincare, microdermabrasion, skin needling, laser skin treatments and any other product or treatment promoted. Vitality Centre operates clear and established terms and conditions / consumer rights policy, as outlined in this document for your protection, and for ours.

4.0 By entering into business, booking a treatment, buying a product, contacting the company by email, undergoing training, applying for a job, signing any document offered to you by Vitality Centre LTD, or using the online booking system, you agree that you have read, agree, and fully understand the following terms and conditions as is your legal obligation.

5.0 TREATMENT RESULTS

5.1 In the case of undergoing a treatment, Vitality Centre expressly does not offer guarantee of any ‘results.’ Furthermore, under no circumstances does Vitality Centre claim to cure, heal, mend or improve any condition physical or otherwise. 

5.11 Any “emergency” case will be referred to emergency services and should not contact Vitality Centre. 

5.12 Attendees accept that if they suspect illness, they must consult a medical practitioner, and that a wellbeing clinic is not a doctors office. Any advice or recommendation offered is done so under the assumption that attendees are well, have not received any medical diagnosis, and are not suffering from any underlying medical condition as per intake forms.

5.13 Any review posted pertaining to dissatisfaction due to not getting “results” is a breach of contract since the client agrees explicitly that no “result” is guaranteed under any circumstances. 

5.2 Vitality Centre offers food sensitivity testing, and does not diagnose any condition including food intolerances or allergies. Bioscan technology is used to establish galvanic skin testing responses which may or may not indicate an imbalance to certain items, but which does not constitute or substitute any medical diagnoses. 

5.21 Food sensitivity testing results and all tests may be deleted after a period of 24 hours or may be stored on file as is necessary for clinical reference. No obligation exists to store test results previously issued. All tests are non-diagnostic and are not used to identify illness, prescribe or offer medical advice. 

5.21.1 It is the responsibility of the client to thoroughly read and understand all information pertaining to any test, treatment or other service, or products offered in advance.  

5.21.2 The clients choice to make lifestyle or diet changes or to purchase vitamins, or to undergo treatment, or make lifestyle changes based on test results or otherwise is voluntary and 100% at their own discretion.

5.22 You are obliged to consult a GP if you suspect allergies or any other conditions. By undergoing food testing, you accept that a food test may or may not indicate a food intolerance. Those seeking to identify allergies should seek medical advice. An allergy is a medical condition which can only be diagnosed by a GP. Vitality Centre Ltd does not offer allergy testing or food intolerance testing. 

5.23 Vitality Centre provides food sensitivity testing which aims to identify imbalances which could be linked to suspected food intolerances. Identifying such imbalances may be useful when planning to undertake trial elimination of imbalanced foods to overcome suspected food intolerances.  Such imbalances are non permanent and should be removed from the diet for no more than three months.

5.3 Teeth whitening at Vitality Centre is referred to as Naturally White or Smile White. The treatment is designed to remove stains to create whiter teeth. However, the treatment does not bleach and therefore cannot change the natural colour of the teeth. The expected outcome cannot be predicted and results vary from person to person. The treatment is ideal for those seeking natural looking results, as it successfully removes stain. 

5.31 Teeth are organic. They are never pure white. Very commonly, there exists fluorosis (white spots) lines of occusal force and other ad-hoc formations. You accept by undergoing teeth whitening that such formations are already present in the enamel, and that whilst not created by teeth whitening, they may be revealed by the treatment. 

5.32 Lines of occlusal force are normal and are present in advance of treatment. These are thin-hair-like lines in the teeth. 

5.33 No guarantee or prediction of result is offered since all teeth vary and results depends on natural enamel colour.Teeth whitening outcomes cannot be predicted in advance. The client agrees to accept the result achieved without dispute and not to post bad reviews online in the event that they are not satisfied with their results. 

5.4 Colonics may result in cramping, pain and bloating especially in the event where there is underlying chronic constipation. You agree to following the aftercare given. You understand that you will not see improvements to gut health instantly. Any potential improvements can be expected only after undergoing a course of at least three treatments.

5.5 Skin treatments. You accept that reactions, and allergies can occur during and after skin treatments, and agree to follow the aftercare provided.

5.5 Non-Medical Treatments: All treatments workshops and advice including that given during food sensitivity testing, colonics, skin-care and full body MOT are non-medical and non-diagnostic and should not replace advice from a doctor. As a wellness clinic, Vitality Centre LTD aims to improve vitality and nothing more. This may or may not be achieved. If the client requires a medical diagnosis, they are recommended to contact a registered physician. The client understands that tests carried out by Vitality Centre LTD do not replace a doctor’s diagnosis of any food allergy or medical condition.

5.6 Allergies You accept that food allergies are more serious conditions than food sensitivities, have educated yourself around such, and accept that a known allergy may result in hospitalisation and may not show up in food sensitivity testing due to variables beyond the control of Vitality Centre LTD. Those with suspected allergies must follow the advice of their medical practitioner above that advice offered or shown by any wellness test provided.

5.7 Suitability Vitality Centre provides various holistic non medical wellbeing treatments. You accept that we reserve the right to refuse treatment to any person at any time, that therapy or treatment is not intended as a substitute for medical, psychiatric or psychological care.

5.71  If you need counselling or feel you do, you should contact a registered counsellor. Vitality Centre does not diagnose medical conditions, claim to offer results, nor does it prescribe medications or recommend any other substance or product. Any lifestyle changes undertaken are made through and by way of free choice and by the free will of the attendee and should be fully researched in advance.     

5.72 Vitality Centre does not recommend any treatment is carried out whilst under the care of a medical practitioner or psychiatrist. Wellbeing treatments are elective and can be booked without prescription or referral, however Vitality Centre reserves the right to offer treatments only to those it feels are suitable and to refuse treatment to those who it feels would be unsuitable for any reason whatsoever.            

5.8 Suggestion Therapy:    The content of recordings or PST sessions is created for the individual. It is provided for general informational purposes only. It may not be accurate, complete, or up-to-date and should not be relied upon as legal, financial, medical or other professional advice. Any actions or decisions taken based on this information are the sole responsibility of the user. Vitality Centre expressly disclaims any liability for any loss, damage, or harm that may result from reliance on this information, nor does it accept responsibility for the content, accuracy, or opinions expressed. When you undertake this treatment and decide to listen to a recording it is accepted that permission has been received from a medical adviser and that no underlying medical or psychiatric conditions have been diagnosed.      

6.0 RISK & WAIVER

All treatments and products carry risks. You agree to waiver your rights to legal claims. You agree to waiver any personal damage claim caused to yourself during your visit to Vitality Centre or thereafter by falling, fainting or otherwise.

6.1 No results or improvement to any condition is guaranteed and all treatments, training, in-house training and related activity is undertaken voluntary. By signing the in-take form, undergoing treatment or by attending Vitality Centre, you accept the terms and conditions outlined herein.

6.2 Any unusual symptoms should be reported to and checked with a GP before continuing with additional treatment at Vitality Centre. It is your responsibility to contact a registered practitioner in advance of treatment if you have underlying symptoms or if you suspect you may have and any such must be declared on intake forms by written declaration. By continuing with treatment, it is agreed you have permission from a medical physician. 

6.3 Fainting: This can happen to anyone, anywhere, and is not the fault of Vitality Centre. Do not fast in advance of attendance at Vitality Centre LTD for any treatment or procedure for more than 2 hours. Blood sugar levels must be stable and fainting may occur if they are not. Vitality Centre LTD will not be responsible for those who disregard this advice or who follow programmes of fasting or cleansing from other providers. Those who faint during treatments or suffer cramping or severe pain post treatment are recommended to follow the instructions of Vitality Centre Ltds aftercare information.

6.4 Unexpected Treatment Outcomes: Unexpected outcomes can happen from time to time. Bloating, cramping, severe pain, discomfort may be experienced post gut health treatment such as colonics and related treatments. You agree not to undergo treatment in advance of a special occasion, or where excessive alcohol is likely or if you are planning to undergo some other treatment with another practitioner. In the case of any adverse reaction, do refer to aftercare, and see a doctor if necessary. Those who undergo one treatment and have a history of bowel or gut health problems will likely experience these side effects and feel worse before they feel better in some cases. 

6.5 Reporting Treatment Outcomes: Any suspected adverse reactions thought to be related to any treatment must be reported to the clinic within 12 hours of a treatment. If outside this time, the outcome will not be linked to Vitality Centre but to unrelated lifestyle activities undertaken since that time. Vitality Centre LTD will therefore not enter into discussion about such matters.   

6.6 Doctors letter   : Any suspected condition should be reported to a doctor and checked  to ensure no underlying medical conditions exists. 

6.61 Letter from Doctor: You may be required to present a doctors letter to verify that any suspected condition has been checked by a medical professional before undergoing further treatment.  It is still at the discretion of Vitality Centre to provide treatment.             

 7.0 Booking & Cancellation In event of cancellation due to illness, bereavement or for any other reason, proof of such may be required. By entering into business and booking a treatment, you accept that notifications regarding such a treatment booking may be delivered to you including opening times, time of your appointment, reminders etc. These are automatically generated by the booking system. 

7.1 Cancellation. Vitality Centre must be notified 48 hours in advance in writing via email of a cancellation. Telephone messages, text messages, social media message do not constitute a confirmed cancellation. You may be asked to verify your written cancellation. 

7.2 Times: In the online booking system, appointment times are blocked on the hour. This includes a buffer time to change from one client to the next. It is no way indicates the length of the treatment which varies as per the requirement of each client. If you wish to know the approximate length of a specific treatment , please contact the clinic in advance but often the treatment time is tailored to the clients needs. If an attendee arrives late and treatment is offered, that treatment time may be reduced to accommodate the resulting delay.

7.3 Health Insurance: Vitality Centre does not guarantee that any treatment will be covered by any health insurance or any other policy. This can be checked by the individual with their respective insurance company or policy and is 100% not the responsibility of Vitality Centre LTD. Vitality Centre will not enter into discussions around insurance claims, but will of you a receipt which may or may not be acceptable to your insurer. 

7.4 Group bookings must be booked online: More than 2 persons is considered a group. In the case of a person seeking to book for more than any two persons at any time, full payment will be required for both or all persons and they will need to book themselves in online. This is due to the length of time that it takes a therapist to take bookings from a variety of people all at once,  and to take deposits etc. Therefore, online booking is necessary for those who wish to book several people in at once.

7.5 Discounts: Discounts are not offered under any circumstances for group bookings or otherwise. In the event of any group seeking to book appointments, it will be necessary for full payment to be made for all people attending in advance. 

7.51 Group bookings No booking will be confirmed for a group unless full payment is received for all persons attending. Refunds will not be given for or against the booking of any person in the group who cancels or fails to attend their appointment with less than 48 hours notice.  

7.6 Vouchers: Vitality Centre does not offer vouchers. Booking or paying for a treatment on behalf of someone else as a gift or otherwise does not constitute a voucher. In the event of booking, and paying for a treatment on behalf of someone else, failure to arrive without 48 hours written notice will forfeit the payment. Repeated booking and failure to turn up will result in the payment being held in lieu of clinic time wasted.

7.7 Online Booking: A booking will be made in the name of the person making the booking and payment for all parties will be deducted from their card via telephone. You may be required to use the online booking system rather than book in person or via telephone.

7.8 Recommendations: No advice given by a manager, online social media manager, instructor, therapist of any other person over-rides the terms and conditions written herein and is not intended to replace advice from a medical doctor. Any supplement treatment, lifestyle or dietary changes should be undertaken only after consultation with a medical physician.

7.9 Commission: Vitality Centre does not offer commission to those who refer others for treatment.

7.10 Deposits/Consultation Fees: In the event of a booking being made online for any treatment or otherwise or via telephone, a non-refundable minimum deposit is required. This deposit acts as 1. the cost of consultation, 2. a holding fee.  If in the event that the treatment is offered, the outstanding balance is required. If in the event that treatment is not offered for any reason, the deposit being a consultation fee is absorbed.  The deposit and in some cases the full payment will be held by Vitality Centre in order to book out the space, and to cover costs if in the event that treatment does not proceed for any reason. If for any reason the client fails to attend the appointment without 48 hours written notice, this deposit and or full payment will not be returned.

7.11 Unsuitability: It is the attendees responsibility to check Vitality Centres website to ensure they are suitable before booking. If a treatment is booked but cannot be provided due to a contraindicated pre-disposed condition, undisclosed in advance of treatment, or if it is found that the attendee is on medication which contraindicates the treatment being done the deposit is non-refundable . It is the responsibility of the client to check in advance, either online or via email, and to disclose any medical conditions or disability by written email in advance of treatment, to verify if treatment is suitable.

7.12 Late arrival: Late arrival for treatment will not be refunded. Those attending should arrive no more than 15 mins in advance and no less than 5 minutes late. Arriving more than 5 minutes late may result in non provision of treatment.

8.0 Defamation or Damage to Business Under the Defamation Act 2009, any slanderous or malicious material or threat including the threat to defame online or damage the business in any way, via email, online or verbally will be investigated and may result in prosecution

8.1 Online Review: In the event of dissatisfaction, you are obliged to contact us via email so that a resolution can be found. Slanderous online review or untruthful malicious material published online may result in legal proceedings.

8.2 Slander: Online review scams, requesting under payment to remove slanderous material or attempting to extort money by threatening slander may result in prosecution.

8.3 Cause Undue Upset: The following are considered violations against Vitality Centre LTD and compensation for damage to business may be sought if any of the following are found to be carried out against Vitality Centre Ltd, or its staff, customers or stakeholders.

8.4 Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy, GPRD and publicity) of Vitality Centre or its staff, customers or stalkholders

8.5 Expose Vitality Centre or its employees to breaches of privacy or GDPR

8.6 Cause loss of business by exposing Vitality Centre or its staff to upsetting material or stress inducing material unnecessarily.

8.7 Par-take in activity that causes upset or undue stress to Vitality Centre customers or staff

8.8 Par-take in organised activity, or consort with others who attempt to cause upset or undue stress to Vitality Centre customers or staff

8.9 Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

8.10 Upload files that contain photographic material, videos software or other material protected by privacy or intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.

8.11 Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.

8.12 Advertise or offer to sell or buy any goods or services for any business purpose, unless such product specifically has been authorised by Vitality Centre LTD

8.13 Conduct or forward surveys, contests, pyramid schemes or chain letters.

8.14 Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.

8.15 Falsify or delete or remove any private files, forms or other material from Vitality Centre LTD

8.15 Restrict or inhibit any other user from using or entering Vitality Centre, or creating loss of business in any form intentionally or otherwise.

8.17 Attempt to extort money through fraudulent means such as claiming to have a contract with Vitality Centre, including employment contract, training contract, sales contract, lease or otherwise.

8.18 Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.

8.19 Harvest or otherwise collect information about others, including e-mail addresses, without their consent, or breach GDPR as a trainee, employee, customers, or stakeholder in any way whatsoever knowingly or unknowingly.

8.20 Vitality Centre reserves the right to cancel or decline any client deemed unsuitable at their own discretion.

8.21 Loss or damage to property or other items is not Vitality Centre responsibility. No compensation will be offered. 

9.0 REFUNDS

In accordance with the sale of goods act 1980, Vitality Centre Ltd does not offer refunds or additional treatments or any other monetary compensation or otherwise without exception for any reason. The client, or trainee accepts that results in treatments cannot be guaranteed due to variables outside the control of Vitality Centre LTD. By entering into business with Vitality Centre Ltd, the buyer accepts this.

 

9.1 Vitality Centre LTD is not obliged to enter into any discussion regarding refunds or discounts once the  treatment has been consumed or a period of 3 months has lapsed since treatment was paid for in the event of a course or package being booked

9.2 In the event of an incomplete treatment for any reason that results in the client leaving early by their own choice or as a result of dismissal or if the client has arrived late or treatment was late to start , the full amount of the treatment is payable before leaving the clinic.

9.3 Emails, phone calls and other communications may be recorded. It is not permitted to arrive at any Vitality Centre Ltd location without a prior appointment, and loitering will result in investigation by An Garda Siochana. 

9.5 Courteous Behaviour: Any contact with Vitality Centre Ltd must be courteous to avoid undue stress to the wellbeing of our staff. Arrival at Vitality Centre making undue demand for refunds, or otherwise, using abusive language, intimidating behaviour, refusing to leave when asked to do so, or otherwise causing undue stress, or obstruction to staff or customers is considered harassment and will be reported as such to Gardai. 

9.51 Persistent emails or phone calls of a bullying, demanding, unreasonable, threatening or aggressive nature are deemed harassment. Such behaviour will not be entertained, and will be reported to An Garda Siochana.

9.6 Feedback Form In the event of dissatisfaction for any reason with any treatment, or training you have the right to air dissatisfaction in writing.  If after you have expressed yourself you may be required to complete a feedback form. If, once that form is reviewed, there is no need for further conversation, you will not receive further communication. This means we have read your comments, consider the matter closed, and see no need for further explanation or discussion, as there is no issue. After this point, any attempt made to undermine the company may be deemed harassment and may result in prosecution.

9.7 Unreasonable Expectations No improvements are guaranteed. Treatment may be refused to persons requesting gaurantees of improvements or who are deemed to have unreasonable expectations of treatment outcomes. Vitality Centre reserves the right to offer treatment at its discretion, and to refuse also treatment in such instances.   

9.8 Prepaid Treatments Returned: In the case that we do not wish to offer treatment, and where a prepayment has been made, this will be returned to you via bank transfer or the means which the payment was originally made. This is  not a refund, but rather the return of monies for a treatment which we will not provide.             

9.9 Shipping fees: any additional customs or shipping fees added to any product on delivery must be paid by the recipient.

9.11 Returns: In the event that an item is not working on arrival, you must report the fault within 24 hours of receipt of package. 

9.10. Product guarantee begins from the day of payment for the product and is valid for 6 months. In the event of breakage a repair service if offered within that time in Ireland only.  

10.0 PERSONAL PRIVACY & GDPR

By booking a treatment, or having any contact with Vitality Centre, you will be added to Vitality Centres email database. Consent to receive initial promotional communication is granted in accordance with Vitality Centres terms and conditions. In line with GDPR, all promotional emails and text message communication from Vitality Centre Ltd offer you the opportunity to “opt out” or unsubscribe. It is your obligation to do so if you do not wish to receive further communication. 

10.1 Any behaviour or language or communication deemed unreasonable, inappropriate, violent, threatening, excessive or violating will be reported to A Garda Siochana and may result in a criminal record. Any action that is considered non-cooperative such as refusal to fully complete forms is considered a ground for refusal and no refund will be offered.

10.2 Any company, person or organisation who breaches the GDPR of Vitality Centre by disclosing sensitive data to its staff or customers knowingly or unknowingly by email, online or otherwise will be sought for damages.

10.3 Any company, person, or organisation who causes undue stress, loss of reputation, stress by breaching GDPR will be sought for damages.

10.4 Under the Non-Fatal Offences Against the Person Act 1997 and the Offences Against the Person Act 1861, Vitality Centre Ltd staff reserve the right to refuse to communicate or provide service to any person deemed to be exhibiting signs malicious behaviour, or symptoms of alcohol, illness, contra-indicated conditions or drug usage or who is exhibiting any form of suspected altered state or medically contraindicated ailment or who is unfit to have treatment for any reason suspected or otherwise.

11.0 AFTERCARE

11.1 Aftercare Instructions; You agree that you have received an aftercare , or know where to find it on our websites and you agree to follow the care provided therein. If in the unlikely event that you do not receive aftercare, you agree to request it, or look for it online. If aftercare is not received, it should be requested. It is your responsibility to ensure that you familiarise yourself with the aftercare related to your particularly therapy. Aftercare instructions can be received either verbally or in writing.

11.2 You will be given the treatment for which you complete the form. If you wish to undergo a different treatment to the one stated on the form you completed, you are obliged to notify staff that you wish to have a different treatment and complete a different form.

12.0 IMPLIED CONSENT

12.1 If for any reason a form is not completed, consent is implied by booking an appointment, visiting the clinic and physically undergoing the treatment. Late arrivals without 48 hours of notice are considered treatments consumed as clinic time has been taken up. Since the booking or clinic time cannot be offered to another client, you may be charged or billed or the treatment cost deducted from pre-paid sessions or from credit card. If a client attendee arrives late and treatment is offered treatment time may be reduced to accommodate the resulting delay.

13.0 PREPAID TREATMENTS AND PACKAGES

13.1 Packages, and prepaid treatments or training classes advance will be valid for up to 3 months or otherwise if a specific time is stated precisely in writing. No refund or extension will be offered under any circumstance. If the treatment, or pre-paid class or training is not used within this time, it is considered null and void.

13.2 Vitality Centre Ltd reserves the right to cease communication on any issue that it considers closed.

14.0 TRAINEE DECLARATION & TERMS AND CONDITIONS

Vitality Centre is a training facility which offers various distinct training options including training for other therapists who wish to train with a view to operating as business, and also to those being considered for employment, referred to herein as ‘in-house’ training.

14.1 Payment and fees pertaining to training must be received in full before training can commence. Training at Vitality Centre is charged at 50 euros per hour, or the precise figure stated and agreed otherwise in writing. This covers the cost of using our facility, accessing our services, devices, equipment, clients as well as the professional training, and additional supervision provided whilst the trainee is onsite.

14.2 Those undergoing training, in-house or otherwise are legally bound by the terms and conditions herein, and understand your obligations as a trainee.

14.3 Those interested in gaining employment at Vitality Centre accept that no offer of employment will be made until they have undergone the necessary training. In particular for the provision of colonic hydrotherapy, a specialised treatment of which we are the only training school Ireland.

14.4 Under no circumstances can those who have not undergone training work at Vitality Centre

14.5 During traineeship, you accept that you a cost to the company resources. Any action undertaken by you does not constitute value added to the company, and will not be compensated as such.

14.6 Trainees accept that training does not constitute employment

14.7 Those being considered for employment, so called ‘In-House Trainees’ are generally not charged for the training, or for use of clinical facilities in general. However, in the event that loss, damages, stress or unforeseen costs are caused to Vitality, training costs charged at 35 euros per hour are required to be reimbursed.

14.8 Whilst on the premises, trainees will act in a courteous manner towards staff and customers or will be required to leave.

14.9 The business operates Monday to Saturday which means that trainees must attend during these hours.

14.10 Trainees will be dismissed immediately and required to leave the premises in the event of the following; theft, fraud, breaches of health and safety, complaints made by customers, discourteous behaviour, refusing to carry out training orders, arguing, fighting, assault, breaches of GDPR, discrimination, removal or misuse of data, theft of material, theft of data, being under the influence of drugs or alcohol, damage to property, late arrival or non-attendance.

14.11 Training, and associated the treatments offered during training are undertaken on a voluntary basis.

14.12 All fees for training are required to be paid in advance, or in the case of in-house training where training fees are forfeited with a view to a potential job offer at Vitality Centre, to be paid back in full in the event that no job offer is made at the end of the training period. Training is charged in this case at the discounted rate of 35 euros per hours as opposed to the full training charge of 50 euros per hour.

14.13 Trainees may not engage with any business with competes with Vitality Centre during the training period.

14.14 Trainees accept that they are not employed by Vitality Centre. Those undergoing in-house training with a view to possible employment accept that they are, during the course of their traineeship being assessed to ensure suitability. Being given the opportunity to train does not guarantee a position.

14.15 Training is charged at 50 euros per hour. This fee is forfeited for those who are being considered for employment. However, in the event of dismissal, undue stress, loss or damages caused, the trainee will be required to returned the full amount due to Vitality Centre.

14.16 Training is referred to and counted in ‘hours’. The term hours is not interchangeable with working hours, and does not constitute employment of any type.

14.17 Under no circumstances are trainees permitted to liase with outside organisations during the course of their traineeship.

14.18 For trainees undergoing in-house training with a view to employment, the opportunity will be given to acquire the necessary clinical, clerical and ad-hoc duties aimed at ensuring efficient management of a clinical space. This training is charged will be required to be reimbursed to Vitality Centre in the event of failure to meet the standards necessary to make a job offer, or in the event of loss, costs or damages being caused to Vitality Centre as a result or during the inhouse training period.

14.19 During the course of training trainees, and those being considered for potential employment at Vitality Centre are required to undertake ad-hoc clerical, clinical, and administrative duties in preparation for operating within a clinical space. This does not constitute employment. Breaches of confidential or sensitive material accessed during training period may result in legal action.

14.20 In-house trainees who are not deemed appropriate for employment at the end of the in-house training, or who fail to complete the training standard required will be dismissed, and may be requested to return full training fees, and costs of treatments undertaken.

14.21 Training hours are calculated in hours. In no way does the use of the term ‘hours’ does not constitute working hours.

14.22 Colonic Irrigation training for those seeking to train in just that discipline, takes 100 hours. However, ‘in-house’ trainees who put themselves forward for training at Vitality Centre with a view to employment will be required, if offered a job, to perform other duties and treatments. Therefore such in-house trainee will be required to complete additional training over and above 100 hours in order to bring them up to the standard necessary in all areas.

14.23 If by the time a trainee who is being considered for employment completes 150 hours and is still not proficient, they will be dismissed, and training fees will be required to be reimbursed.

14.24 Those who undergo the 100 hours colonic irrigation therapist training treatment are required to train for 100 hours.

14.25 As part of the training process, trainees may undergo treatments. Generally, treatments are provided free of charge for paying trainees, but may be requested to be re-imbursed in the event that the trainee causes losses, damage, or costs by their behaviour, action during or after the trainee period.

14.26 In signing the Trainee Declaration at Vitality Centre, or by undertaking training by way of active or inactive participation, all trainees agree to the above, and to all the terms and conditions outlined herein.

14.27 In-house training requires the trainee to gain proficiency and have access not just in colonic hydrotherapy but to all treatments offered at Vitality Centre as well as in the standard operations within the clinical space.

14.28 Those who wish to undergo training with a view to potential employee accept that they may not be offered a job, but in most cases will not be required to pay for the training received.

14.29 Those who cause undue stress, loss of business, damage to reputation or legal costs to the business will be required to pay the full cost of training to be estimated as the total time that they vacated the premises.

14.30 You accept that no pay out made by Vitality Centre to any trainee can be considered wages, and do not constitute working hours.

15.0 ONLINE BOOKING & INTERNET POLICY

15.1 Incorrect use of PayPal: In cases where a payment is withheld for any treatment using PayPal or other online payment system for any reason or which causes Vitality Centre Ltd to issue documents and other proofs of attendance, the consumer gives up the right to this information and in agreement. In the event of any outcome that costs Vitality Centre ltd time, money, inconvenience or extra work load due to administration, a fee of 50 euros will be charged to the client.

15.2 AGREEMENT BETWEEN USER OF BOOKING SYSTEM AND VITALITY Centre LTD Web Site is comprised of various Web pages operated and owned by Vitality Centre LTD AND THIRD-PARTY BOOKING SYSTEMS, SOFTWARE AND PAYMENT ACCEPTANCE SYSTEMS. The Vitality Centre LTD website usage is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Vitality Centre LTD Web Site constitutes your agreement to all such terms, conditions, and notices.

17.2 Vitality Centre LTD reserves the right to cancel any treatment at any time for any reason and to refuse any person for any reason for any treatment without refund.

17.3 This policy is in line with the consumer rights and sale of goods act 1980. As a customer, it is your obligation to read this document in advance of treatment and to understand and accept the terms and conditions of doing business with Vitality Centre LTD as outlined herein and your responsibility as a consumer.

18.1 Vitality Centre LTD reserves the right to change the terms, conditions, and notices under which the Vitality Centre LTD Web Site or treatments are offered, including but not limited to the charges associated with the use of the Vitality Centre LTD Web Site and classes or treatments.18.2 Automatic message sent by our third party booking system cannot be controlled by Vitality Centre and will not be considered breaches of personal data or GDPR.
